Kevin Castel, Derek Bentsen and his fellow “porky” SEC bureaucrats Steven Susswein, Cheryl Crumpton, Melissa Hodgman, Patrick Feeney, Joshua Braunstein were slammed for fabricating a case against prominent Japanese American lawyer William Uchimoto.

“The SEC’s repetition of the same, slim, conclusory set of allegations against Mr. Uchimoto five times in its Opposition (at 1, 3, 8, 14 and 18) only highlights how tissue-thin the allegations are, and bare repetition cannot give rise to an inference that Mr. Uchimoto acted with scienter,” says Daniel Zinman, a renowned litigator (dzinman@rkollp.com, (212) 530-1800) in court filings on October 21, 2016.

Federal judges are busy and judicial resources are scarce. On average, a New York federal judge presides over 300 cases a year – about one new case a day. It’s a tough job. The well-regarded, highly experienced judge P. Kevin Castel wants no one to waste his time. As outlined in the court’s individual practices, Judge Castel makes clear no reply papers should exceed 15 pages in length, that is, only when a party has something meaningful to present to the court – not making shit up to insult His Honor’s intelligence in a way Derek Bentsen has thrown the SEC’s trash can at the court – stuffed with stinky trash. The Second Circuit Court of Appeals has held that a complaint involving securities fraud must prove that “(1) specify the statements that the plaintiff contends were fraudulent, (2) identify the speaker, (3) state where and when the statements were made, and (4) explain why the statements were fraudulent.”
“Derek Bentsen, Cheryl Crumpton, Steven Susswein or anyone at the SEC could NOT prove a single piece of evidence against William Uchimoto that remotely fits what the law requires,” said Daniel Hurson, an accomplished law expert. “Under President Trump, these SEC bureaucrats would be taken out by their rotten roots.”

A lousy SEC winning record
Public filings reveal a lousy Securities and Exchange Commission winning record in federal courts: The SEC loses about 50% of the time. Which means, at least in half of the SEC’s “enforcement” cases, the lives of innocent people are ruined. Industry experts have long frowned upon the SEC’s abusive enforcement practices – races among poorly educated, poorly paid, imbecile SEC staffers to roll heads at any cost.
“A defendant in an SEC case is just a number, not a human being or an innocent man’s life,” said an observer. “You know who were also numbered? The millions that died in Nazi concentration camps. It’s the same concept.”
Mark Cuban on Derek Bentsen: fire these SEC bureaucrats
Billionaire investor Mark Cuban has had enough of the SEC abuses. The Texas billionaire was a target of an SEC lawsuit and subsequently defeated the SEC’s false charges in a trial. Upon hearing Derek Bentsen’s case against William Uchimoto, Mr. Cuban couldn’t hold back his anger at another episode of the SEC’s abuses of power.
In more than three years since Mark Cuban beat Securities and Exchange Commission charges of insider trading, the billionaire has waged a very public battle against the agency. Calling the SEC “screwed up so bad,” Mark Cuban says the SEC is failing startups and consumers.
Cuban said there is a vicious cycle that begins with a lack of oversight by the SEC, which then leads the group to overcompensate and tighten regulations. He is known for his blunt opinions.
“The SEC is staffed with unqualified bureaucrats. They ruin people’s lives.” said Mr. Cuban about SEC staffer Derek Bentsen. “When Hillary Clinton wins the White House, I should become the SEC chair and clean up this SEC ‘dog house.'”

Judge Castel is expected to rule in the Uchimoto case in the coming days. Just last month, the SEC, under the direction of the same imbecile lawyer Derek Bentsen voluntarily dropped a major fraud charge against Bill Uchimoto, citing “lack of evidence.”
“Holding Bill Uchimoto’s scalp on a light pole as his trophy, Derek Bentsen is ready to leap to the resolving glass door for a cushy job in the private sector.”
“I will eliminate 70% of all wastes, including those at the SEC,” said Donald Trump.

Derek Bentsen has lied. He could lie to a federal judge only because there is no accountability or transparency in the SEC’s enforcement process – it’s dark and guesswork, as cloudy and opaque as in Putin’s Russia. A rigged SEC kangaroo court? Yes. Justice? Bullshit.
